CHENNAI: Debendranath Sarangi, Chief Secretary and the Vigilance Commissioner, has recommended to the Home Secretary to drop further action against A K Viswanathan, IPS, inspector general of police, in respect of the non-substantiated allegations relating to possession of assets disproportionate to his known sources of income.The charges also included alleged acquisition of 500 acres in Kallikudi village in Madurai district in the names of some companies in which his brother, sister-in-law and some others were direct stakeholders.A copy of this communication dated December 30 last year, was produced before a Madras High Court division bench comprising Justices Elipe Dharma Rao and N Kirubakaran, on Thursday. Vigilance DSP N Jesupadam filed an affidavit stating that the allegations were not substantiated and it was recommended to the Vigilance Commissioner to drop further action against Viswanathan. The Government Advocate also submitted that recording the affidavit, the writ appeal might be closed. Accordingly, the bench closed the appeal, on Friday.“In view of the submission of the Government Advocate and recording the letter of the Vigilance Commissioner’s communication dated December 30 last year, the writ appeal is closed as no further order is necessary,’’ the bench said.Originally, Viswanathan filed a writ petition seeking to restrain the Vigilance and Anti-Corruption department from conducting any inquiry against him. Based on this, a decision was said to have been taken on August 20, 2009 by the authorities concerned and the High Court dismissed it on July 12, 2010 on the ground that it could not interfere in the matter when the competent authority was enquiring into the allegations. Aggrieved, AKV filed the present writ appeal. He also filed another writ petition challenging certain provisions of the DVAC Manual. Since the appeal was closed, there was no need to go into the plea, the bench said and closed it.
