HYDERABAD: A division bench of the High Court comprising justice VVS Rao and justice KG Shanker on Tuesday asked chief secretary SV Prasad to issue directions and ensure compliance with the directions issued by the Service Tribunal.The bench was dealing with the writ petition of a retired tahasildar from Kotapattanam in Prakasam district. He was suspended for giving information under the Right to Information Act to the sarpanch of a neighbouring village.The petitioner said that despite a direction by the Service Tribunal to reinstate him it was not done and also his representation to the collector proved not only futile but found the official directing him to approach the local minister for favourable orders.The bench was critical of the approach of the collector.Status Quo on  TTD RecruitmentsA division bench comprising justice G Raghuram and justice N Ravishanker directed TTD to maintain status quo on limited recruitment of SC/STs in the rank of junior assistants to backlog posts. The bench was dealing with a writ petition filed by affected candidates questioning the procedure followed by the TTD as being contrary to principles of service jurisprudence.The TTD, while filling up 23 vacancies, reserved eight posts for women and later 15 in the general category.It is contended that insofaras general reservation is concerned, reservation is horizontal and all posts must be considered a single unit.When the TTD sought to review its recruitment on the ground of error, the selected candidates challenged the impugned procedure.A single judge dismissed the petition.The bench admitted the appeal and directed the authorities to maintain status quo.No Stay for New Beer Procurement PolicyJustice Vilas Afzalpurkar refused to stay the changed policy of the state government for procuring beer for retail consumption through the AP Bewerages Corporation. Athor Breweries and Leelasons questioned the change in the policy of the state government.In the previous year the Rosaiah government decided to go by national sales figures for fixing the quantity to be procured, in alteration of the earlier practice.The then policy was challenged and its execcution was made subject to the petition pending.Now the present government’s reversal is challenged as illegal.The judge said that he would not interdict the policy and posted the case for final hearing to December.Admissions to NIMSSuper-specialty CoursesJustice Nooty Ram Mohan Rao reserved his verdict on a petition challenging the procedure adopted by NIMS in making admission to super-specialty courses.The judge heard at length the plea of Dr Nagamurali and his claim to a seat in the super-specialty courses of DM and M.Ch.According to the petitioner, the action of the authorities in revising its provisional list announced in June without notice to those affected was in violation of the principles of natural justice.The contention of NIMS is that the revision became necessary to ensure that the results were in keeping with the final accurate key.Order against Vaccine Manufacturer QuashedJustice Nooty Ram Mohan Rao suspended as without jurisdiction the direction of the state drug controller to stall production of the measles vaccine.Indian Immunological Limited, the only manufacturer of the vaccine, was asked to stop production on July 18 following some deaths in Uttar Pradesh and Gujarat.The government-owned company questioned the action as being wholly without jurisdiction since it had a valid licence issued by the central government.The preliminary plea of the state that the petition was not maintainable was rejected by the judge who pointed out that the order lacked in jurisdiction.
