CHENNAI: Since Nakkheeran editor RR Gopal has already obtained anticipatory bail in one case, he should not be arrested in other cases arising out of the same offence allegedly committed by him, the Madras High Court has observed. The First bench comprising Chief Justice MY Eqbal and Justice TS Sivagnanam made the observation on Thursday while passing interim orders on a writ petition from Gopal praying for a direction to the State Home Secretary and the DGP for instruction to transfer, to the Zaam Baazar police station, all the FIRs already registered and to be registered against him in various police stations in the State based allegedly on publication of a derogatory and defamatory article against Chief Minister J Jayalalithaa in Nakkheeran’s issue dated Jan 7 last.Earlier Gopal’s counsel PT Perumal argued that the criminal procedure code did not contemplate filing of multiple FIRs on the one and same offence. In Gopal’s case, hundreds of FIRs had been registered by the police stations, he said.
