FIR against Gehlot in land allotment case
FIR lodged against Rajasthan Chief Minister, four others in Jaipur.

Jaipur: An FIR has been lodged against Rajasthan Chief Minister Ashok Gehlot and four others at the Gandhi Nagar police station in Jaipur in a case relating to allotment of land to Jadu Kamal Babu Laxman Singh Gehlot Magic Trust and Academy.

Jadu Kamal Babu Laxman Singh Gehlot Magic Trust and Academy has been set up in memory of Gehlot's father.

The case has subsequently been entrusted to CID(CB) for investigation, a Police spokesman said here today.

The FIR was lodged under Section IPC 420, 409 and 120B against Gehlot, then Urban Development Minister Takki-u-din Ahmed, Trustees Mahipal Gupta and Anand Awasthi and then Jaipur Development Authority(JDA) Commissioner Dinesh Goyal, on the directives from a local court.

Additional Chief Judicial Magistrate(Jaipur-II) Vinod Giri had directed the police on Wednesday to file the FIR, investigate the case and submit the report before the Court by July 6.

The Court had heard the case afresh on the request praying for lodging of an FIR in this connection, superceding its earlier orders, on the directives from the Rajasthan High Court.

The Single Bench of the High Court comprising Justice R S Rathore while hearing a revision petition a fortnight ago, had quashed the order of trial court and directed it to send applicant Krishna Kumar Bhardwaj's request to the police under Section 156(3) of CrPC for filing the FIR.

Earlier, the lower court case had turned down applicant's request for directing the police to file an FIR and instead held that the court itself would inquire the case under Section 156(2) of CrPC.

The High Court in its order had observed that the lower court did not have an option of that sort but was supposed to forward the request to the police under Section 156(3) itself.

The above trust was allotted 12,500 sq yard of land on May 18, 2003 for a price of over Rs 2 crore by previous Gehlot Government during 1998-2003, but the allotment was not matured as the trust did not avail the government's offer.
