New Delhi: Two youth accused of robbing Rs 600 from two men and injuring them, have been convicted and sent to seven years rigorous jail term on Monday by a Delhi court.
Refusing to take a lenient view or grant probation to the two 19-year-old convicts, Additional Sessions Judge (ASJ) Ramesh Kumar said robbery and dacoity are on the increase in the metros and such crimes need to be dealt with severely.
"The offences of robbery and dacoity with deadly weapon are on the increase in the society, particularly, in the metropolitan cities....If there is identification of the real culprits and the case property is proved on record, the accused persons should be dealt with severely," ASJ Kumar said.
On the night of October 31, 2010, in Azadpur in North Delhi , the convicts, Santosh and Lucky had robbed two persons, Naresh and Bhola Rai, of Rs 200 and Rs 400 respectively and injured them with shaving blades.
The court convicted the duo for offences under sections 392 (punishment for robbery), 394 (voluntarily causing hurt in committing robbery), and 397 (robbery, or dacoity, with attempt to cause death or grievous hurt) of the Indian Penal Code (IPC).
"Keeping in view the facts and circumstances of the case and, in particular, the fact that Santosh and Lucky committed the offences after using shaving blades towards both victims, are hereby sentenced to seven years rigorous imprisonment each and a fine of Rs 20,000 each," the court said.
The counsel for the convict duo had pleaded that they were only 19 years of age and sole earners in their family and sought that they be granted probation or a lenient view be taken while awarding the sentence.
The court, while convicting them, had observed that in many cases witnesses are afraid to identify the real culprits but when they have been identified and the case is proved against them, they should be dealt with severely.
"Normally, the complainant and the other witnesses are reluctant to identify the real culprits, due to their fear. If there is identification of the real culprits and the case property is proved on record, the accused persons should be dealt with severely," the court said.
