CHENNAI: The TN government on Tuesday filed an additional affidvit bringing to the notice of the Madras High Court the resolution passed by the State Assembly on August 30 this year on Santhan, Murugan and Perarivalan, who are on death row in the Rajiv Gandhi murder case.In its earlier affidavit filed in response to the writ petitions from the trio seeking the intervention of the HC in the matter of rejection of their mercy petition by the President of India, the government had stated that it had no remarks to offer.The additional affidavit stated that the government after receipt of the communication from the office of the President, had taken steps as per law. At the same time, in deference to the sentiments expressed by the people and the view of political parties in TN, the State Legislative Assembly on August 30 passed unanimously the following resolution:‘’In deference to the sentiments, the Assembly strongly urges Her Excellency the President of India to reconsider the mercy petitions of Santhan, Murugan and Perarivalan and commute their death sentence to that of life imprisonment.’’This was also communicated to the Union Home Ministry on the same day. The additional counter, however, prayed the court to dismiss the writ petitions from the trio. When the matter came up before a division bench comprising Justices C Nagappan and M Sathiyanarayanan today, the bench was told that a petition seeking transfer of the three writ petitions from the trio from Madras HC to some other HC was pending before the SC and it was to come up again on Jan 11. The bench adjourned the matter till January 31, 2012.
