Patna: On the run ever since the Bihar Vigilance Investigation Bureau called a nationwide alert for his arrest in the flood relief scam, RJD MP Anirudh Prasad alias Sadhu Yadav received a major setback when the Patna High Court rejected his anticipatory bail petition on Monday.
Justice Chandramauli Kumar Prasad turned down Yadav's anticipatory bail prayer after hearing defence counsel Ganesh Prasad Singh and advocate-general P K Shahi for the prosecution.
For Yadav,brother-in-law of RJD president Lalu Prasad, who missed the April 30 marriage ceremony in Delhi of his niece Chanda, the third daughter of Lalu and Rabri Devi, today's order meant he might not be able to attend the reception planned for the couple in Patna on May 10.
The MP's counsel apologised before the court for his client not mentioning his pending bail application in the special vigilance court here in his petition filed in the Delhi High Court which had on April 17 stayed Yadav's arrest till April 24.
The vigilance court had on April 18 dismissed the anticipatory bail prayer of Yadav against whom a no bailable arrest warrant was issued on April 10.
The defence counsel has said that said the error was due to a "communication gap".
Advocate-general P K Shahi pointed out that Yadav had committed the same mistake (suppressing facts) while filing anticipatory bail petition in the Patna High Court where he had not mentioned the fate of his bail petition in the Delhi High Court and requested the bench not to entertain his prayer.
Besides when the Delhi High Court had already dismissed the MP's bail petition on April 24, there was no point hearing the petition here, he said.
