Man gets Rs 10,000 for car breakdown
Maruti Udyog Limited and a dealer were directed to pay the owner Rs 10,000 compensation for car breakdown.

New Delhi: After the car engine became defunct and had to be replaced within days of its servicing, the car owner gets some relief as the State Consumer Commission has directed Maruti Udyog Ltd (MUL) and a dealer to pay Rs 10,000 as compensation to the man.

Dismissing appeals filed by MUL and its dealer, Competent Automobiles Co Ltd, against the order of a District Consumer Forum, the Commission Bench headed by Justice J D Kapoor said the fact that the engine had to be replaced just a few days after its service and replacement of engine oil fell under deficiency of service.

The Commission has asked MUL and the dealer to pay the amount in a month to Puran Chand Wadhwa, a resident of Dakshin Puri in New Delhi.

Wadhwa said he had taken his car for servicing and replacement of engine oil to the dealer in 2001.

Just days after servicing, his car broke down and he took up the issue with MUL, whose engineers said the engine was damaged beyond repair and there was no engine oil though there had been no leakage.

"In view of the reports of the engineers that there was no leakage of engine oil...the only inference that can be drawn is that there was some manufacturing defect or there was some deficiency in the service on part of the dealer. Otherwise where was the need for opening the engine?" as quoted by PTI, the Commission said.

A consumer forum had allowed Wadhwa's complaint and asked MUL and its dealer to pay Rs 25,000 as compensation. Both had appealed against this order.

The Commission, which dismissed the appeal, however, reduced the compensation to Rs 10,000.
