MADURAI: Excessive force was used by the police at Paramakudi on Immanuel Sekaran Memorial Day, which is a criminal offence, according to the interim report released by the Action Committee Against Paramakudi firing.Speaking to media here on Sunday, Justice H Suresh, former Mumbai High Court Judge said, “There was no justification of using excessive force that claimed the lives of seven people and injured many. Neither the Indian Constitution nor the international law holds provision for use of excessive force against peaceful demonstrators. The police action in Paramakudi amounts to offences under Indian Penal Code (IPC) 100 and SC/ST Atrocities Act.”According to the findings, no executive magistrate enquiry has been conducted on the use of fire arms in Paramakudi incident. “There have been several complaints of police attack that went unregistered. A special court should be set up for receiving such cases. It is necessary to have an independent enquiry for which the investigation must be transferred to the CBI,” said Vasanthi Devi, former Chairperson of Tamil Nadu State Commission.Regarding the action to be taken by the government on the outcome of the report, Justice Suresh responded, “Not every judicial commission justifies police action. The state government concerned acts only when the report is in their favour. The report has to bind the government to take action against the people responsible for such incidents.”“The Justice Sampath enquiry commission, which is formed by the state government to inquire into the incident, should be honest and justice should be rendered to prevent such events from happening again in the future,” said Ruth Manorama, Dalit activist.
