Bar on PWD to recover excess salary paid

CHENNAI: The Madras High Court has restrained the water resources department of the PWD from recovering the excess salary paid to an employee.Justice K Chandru granted the injunction on February 27, while passing interim orders on a writ petition from T David Shanmugam, working as assistant in the office of the chief engineer, Chennai region.Advocate RY George Williams cited a ruling of a division bench of this court in 2006, which stated that the excess payment made by mistake on the part of the government authorities could not be recovered at a later stage. It could be done only in the case of the employee himself misrepresenting the facts, the ruling added.
