KOCHI: Unhappy with the Ernakulam Additional Chief Judicial Magistrate (ACJM) decision, Shashi Tharoor MP will soon approach the Kerala High Court in the controversial case in which he allegedly showed disrespect to the National Anthem.Tharoor will challenge the ACJM’s order dismissing his petition requesting the court to summon the Compact Disk (CD) which contains the visuals of the controversial meeting, where he allegedly showed disrespect to the National Anthem. The case is now posted to September 17 for hearing on the question of framing of charges.“We will plead to stay the further proceedings in this case. The misunderstandings on the case can be cleared by viewing the CD. It is a vital evidence in this case. Summoning any document and inspecting it at any stage of the inquiry is the discretion of the court. The court should have exercised its jurisdiction. The magistrate’s order is unsustainable,” Tharoor’s counsel Senior Advocate K Ramkumar told Express.Tharoor is of the view that viewing the CD will end the allegations against him. However, the magistrate observed that the accused has no right to produce any document or witness at the stage of evidence collection for prosecution.The private complaint against Tharoor was filed by Joy Kaitharath, general secretary, State Human Rights Protection Centre, alleging that Tharoor, after delivering the Hormis Memorial Lecture on December 16, 2008, interrupted the National Anthem to urge the audience to place their palms over the heart as the Americans do, instead of the attention posture.
