Madurai Bench of Madras High Court has directed the Tamil Nadu Government to provide an interim relief of Rs 25,000 to a man who lost his limbs while rescuing others when a fire broke out in a crackers unit factory at Mudalipatti in Sivakasi in October last year.
A Division Bench of Justice S Rajeswaran and Justice T Mathivanan directed the state government to submit the details of the victims treated as inpatients in hospitals. The petitioner G Murugesan said his son Armugam went to rescue people caught in a fire accident at Om Sakthi Fireworks at Mudalipatti village on September 5, 2012.
His son sustained serious injuries in an unexpected heavy explosion. He was admitted at Government Hospital at Sivakasi for treatment and later to the Madurai Rajaji Government Hospital for better medical assistance.
He alleged that the hospital discharged him when his condition had not improved. Earlier on the intervention of the Madras High Court (Madurai Bench), treatment was continued to the victim. Further the victim s father sought compensation.
Special Government pleader Alagudevan averred that Armugam was injured only while rescuing his relatives in the fire accident and he was not affected directly in the accident like others and so he is not eligible for the compensation.
Petitioner's Counsel Peter Ramesh Kumar contended that even though the victim s name is placed as second, in the eligibility list for compensation prepared by the State Government no compensation had been given to him.
The court issued directions to furnish the details of Armugam's injuries and treatment provided to him.Further the Judges directed the State Government to provide Rs.25,000 as interim relief before the next hearing. The case was adjourned to June 26.
