Chennai: Rejecting a plea for a CBI probe into the deaths of five persons in an alleged encounter in Chennai on February 22, Tamil Nadu police on Tuesday said investigation by a central agency is 'unwarranted' when two judicial proceedings are seized of the issue.
The purported PIL 'is only duplicating proceedings' and would not serve any useful purpose, especially when both the proceedings under the XIV Metropolitan Magistrate, Chennai, and National Human Rights Commission were judicial proceedings, Director General of Police said in a counter affidavit.
The counter was in response to a petition by P Pugalenthi, an advocate and Director of Prisoners Rights Forum, who also sought a direction to the government to book the policemen, responsible for the killings, for murder.
The DGP said an amendment to the CrPC had mandated a judicial inquiry in such cases to provide transparency and objectivity. In accordance with it, the FIR, in original, was sent to the Chief Metropolitan Magistrate and hence the XIV Metropolitan Magistrate had commenced a judicial inquiry.
The officer said that as per National Human Rights Commission guidelines, the case was transferred to CB-CID by a February 25 last order. Besides, NHRC had been informed and mandatory reports had been sent to the comission.
Five persons suspectedly involved in two bank robberies in the city were shot dead by police during the alleged encounter.
