Delhi Court Orders Filing Perjury Case Against Woman for Levelling False Charges
The court directed its staff to file a court complaint against the woman before the Chief Metropolitan Magistrate for for furnishing false information to the police.

New Delhi: A Delhi court has ordered lodging of a perjury case against a woman for levelling false rape charges against three men, observing that she had caused humiliation to the accused and made a mockery of the judicial system.

The court pulled up the woman, a mother of two daughters, for implicating the men in a criminal case of "serious nature" knowing that they had not committed any crime against her, setting in motion the state machinery and getting the accused chargesheeted.

"I am of the opinion that this is a clear case of furnishing deliberate false information to police, a public authority, thereby making the police use its lawful authority to cause injury to the reputation of the accused.

"Therefore, I deem it proper to prosecute the prosecutrix for the criminal offence (perjury) in the interest of justice and for making mockery of the judicial system by which precious time of the court has been wasted in conducting the trial of admitted false case, where accused have suffered humiliation and distress besides facing expenses for litigation," Additional Sessions Judge Shail Jain said.

The order came as the court acquitted the three men, all residents of Hari Nagar in West Delhi, of the charge of rape and saying they had neither blackmailed, nor raped her.

The court noted that during her cross-examination, the woman stated that she had established physical relations with one of the three men on her free will and the other two accused were his friends. She also said she had falsely implicated these men at the instance of her well-wishers.

The woman lodged a complaint at Hari Nagar Police Station alleging that in June 2014, the three men had raped her.

Initially, she deposed before the court that a theft was committed in her house in May 2014, in which Rs 1.2 lakh belonging to her husband and a gold ear ring of her mother-in -law were stolen.

She said she had friendship with one of the three accused and when her husband came to know about it, he told her that the articles were stolen by her friend and asked her to report it to the police.

The woman, who was declared hostile, claimed that she later got to know that rape charge has been added against the men and that they had neither raped her nor threatened her.

The court did not record the statement of the accused men saying nothing incriminating against them has come on record as the woman had turned hostile.
